The Federal Magistrates Court ruled that Refugee Review Tribunal member Steve Karas has been allowing an “inflexible and mechanical” approach to the plight of Hazara ethnic minorities fleeing persecution in Afghanistan “infect” his decisions regarding refugee claims made by Afghan boat arrivals. His understanding of the situation in Afghanistan has been criticised as being “flatly wrong”, and not at all based on facts.

Asylum seekers are not illegal, even if they arrive by boat or without visas. People all over the world are forced to cross national borders without proper authorization because of war and conflict. Seeking asylum is often the only option for people fleeing torture, persecution and inhumane conditions in their home countries. Only 1% of refugees in the world will get a resettlement place through the UN in a safe country, the rest rely on the right to seek asylum.
