The ‘refugee swap’ deal between Malaysia and Australia was signed on Monday by the interior ministers of both parties. Eight hundred asylum seekers arriving in Australia from this date, 25 July 2011, will be sent to Malaysia for processing, including unaccompanied minors. The deal has been criticized on the grounds that Australia is devolving its obligations under the 1951 Refugee Convention to a country with a shocking track record in its treatment of refugees and asylum seekers. More importantly, human rights organisations believe that it would trigger a decline in refugee protection in the Asia-Pacific region.

Under the Refugee Convention, Australia is obligated to process all asylum seekers that arrive in Australian territory in Australia. The Australian government has reassured the public that human rights protection is a crucial part of the Malaysia deal. However, Malaysian immigration laws still do not recognize refugees and asylum seekers, so there’s no real guarantee for protection.
Given that Australia receives such a small number of asylum seekers each year, this policy is especially unnecessary.
