A third major defeat in the Australian High Court has dealt yet another blow to the Gillard government’s refugee policy. The High Court ruled that a young Afghan refugee was wrongly denied the chance to visit his mother because of lengthy delays in the VISA application process. In a decision that has implications for scores of refugees who arrived in Australia as unaccompanied minors, a full bench of the court ruled yesterday that the government’s construction of its legislation could lead to ‘’capricious and unjust’’ results.

There are 463 asylum seekers in immigration detention waiting for ASIO to complete security checks, and more than 50 people with negative ASIO assessments that have condemned them to indefinite detention, despite being genuine refugees.
